Terms of Service

These Terms govern your use of the Key Of Bike website and platform ("Platform"), operated by Gariba IT Services Pvt Ltd. They apply to both buyers (consumers using the enquiry/test-ride form) and dealers (business subscribers). By using the Platform, you agree to these Terms.

What Key Of Bike is

Key Of Bike is a two-wheeler lead-marketplace and dealership platform. We connect a buyer's enquiry with one verified local dealer. We are a facilitator only — we are not the seller of any vehicle, we do not own inventory, and we do not guarantee any sale, vehicle availability, price, finance approval, or test ride. All vehicle transactions are strictly between the buyer and the dealer.

Buyer terms

• Provide accurate information in your enquiry.
• By submitting the form, you consent to your details being shared with one verified local dealer who may contact you by phone, WhatsApp, or email.
• The Platform is free for buyers. Any negotiation, purchase, pricing, finance, and after-sales matters are solely between you and the dealer.

Dealer terms

• Dealers must be genuine, lawfully operating two-wheeler businesses with accurate business details.
• Dealers must respond promptly to leads, deal honestly with buyers, and comply with applicable laws.
• Dealers must use buyer data only for the specific enquiry and in line with our Privacy Policy and the DPDP Act. Reselling, spamming, or misusing buyer data is strictly prohibited.
• Each qualified lead is routed exclusively to one dealer.

Subscriptions & billing (dealers)

Dealer access is a monthly subscription (plans approximately ₹2,500–₹20,000/month), billed via Razorpay, charged in advance per cycle. Applicable taxes (GST) apply. See our Refund & Cancellation Policy.

Acceptable use

You agree not to submit false or fraudulent enquiries, scrape data, attempt unauthorised access, interfere with operations, infringe others' rights, or use the Platform unlawfully.

Intellectual property

The Platform — including its software, AI lead-scoring, design, branding, and content — is owned by Gariba IT Services Pvt Ltd and protected by law. You may not copy, modify, or redistribute it without our written permission.

Disclaimers

The Platform is provided "as is" and "as available." We do not warrant uninterrupted service, lead conversion, lead quantity, or the conduct, quality, pricing, or legitimacy of any dealer or buyer. AI lead-scoring is an aid, not a guarantee.

Limitation of liability

To the maximum extent permitted by law, Key Of Bike and Gariba IT Services Pvt Ltd will not be liable for indirect, incidental, or consequential damages, or for disputes between buyers and dealers. Our total liability for any claim relating to the Platform will not exceed the subscription fees paid by the dealer in the three (3) months preceding the claim.

Termination

We may suspend or terminate access for breach, non-payment, or misuse. Dealers may cancel per the Refund & Cancellation Policy.

Governing law & jurisdiction

These Terms are governed by the laws of India. The courts at Bhopal, Madhya Pradesh have exclusive jurisdiction over any disputes.
